By signing below, I hereby acknowledge that I have knowingly and willingly entered into a Hunting Lease with Cross Texas Outfitters through The Texas A&M University System (“TAMUS”) and/or the Texas Agricultural Experiment Station (“TAES”). I understand the terms of the terms, provisions and conditions of the Lease, and agree to abide by such terms.


HUNTER’S RELEASE OF LIABILITY
In consideration for receiving permission to hunt on property owned or leased by Cross Texas Outfitters through The Texas A&M University System, I hereby release, waive, discharge, and covenant not to sue, and agree harmless for any and all purposes Cross Texas Outfitters or The Texas A&M University System and the Board of Regents for The Texas A&M University System, and their officers, servants, agents, volunteers, or employees (herein referred to as RELEASES) from any and all liabilities, claims, demands or injuries, including death, that may be sustained by me while participating in such activity, or while on the premises owned or leased by RELEASES, including injuries sustained as a result of the negligence of RELEASES.
I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, which may be sustained by me as a result of participating in said activity, including injuries sustained as a result of the negligence of RELEASES.
I further agree to indemnify and hold harmless the RELEASES for any loss, liability, damage or costs, including court costs and attorney’s fees, which may occur as a result of my participation in said activity, including injuries sustained as a result of the negligence of RELEASES.


HUNTING RULES
By signing below, I hereby agree to abide by and adhere to the following hunting rules while I am present on the hunting lease property:
1. To have a valid Texas hunting license (along with a Texas Hunter Education Training Certificate if required by Texas Parks and Wildlife rules and regulations) applicable to the type of game for which I am being allowed to hunt, and to carry such hunting documents with me at all times (including while on a hunt). I agree to provide the hunting license number to Cross Texas Outfitters, and allow them to release such number to a third party, including TAMUS and/or TAES and a game warden.
2. To have a valid driver’s license or identification card, and to carry such drivers license or identification card with me at all times (including while on hunt). I agree to provide the drivers license number to Cross Texas Outfitters, and allow them to release such number to a third party, including TAMUS and/or TAES and a game warden.
3. Prior to hunting, I will check-in with Cross Texas Outfitters personnel on-site or at an area designated by a Cross Texas Outfitters Manager, and follow all instructions provided.
4. Not to interfere with livestock and out-of-season game.
5. To replace, or reimburse the cost of, any personal property, research equipment, livestock, fences, gates, or other property destroyed as a result of my actions or the actions of my guests.
6. To observe safe weapon handling, including but not limited to:
a. Unloading all firearms before attempting to cross a cattle guard, climb over, through or under a fence, cross a ditch, gully, or arroyo, or climb any obstacle or descend any decline.
b. Unloading all firearms while in a vehicle and not shooting from a vehicle or across a road.
c. Keeping all firearms unloaded while in camp or not actively hunting.
7. There will be no drinking of alcoholic beverages in the field. If alcohol is consumed during the daytime hours, it is up to the staff of Cross Texas Outfitters to decide whether or not to allow the hunter to hunt that day.
8. Hunters will be dropped off at their blind and will be expected to remain in the blind and not hunt on foot. If you wound an animal, do not attempt to track it on your own. It is very easy to get turned around and lose your bearings. Stay in your blind and wait for a guide to assist you in tracking your deer.
9. Hunters are expected to not leave trash in the field or in the blinds.
10. To follow all general procedures, rules, and regulations regarding hunting, including applicable Texas hunting rules and regulations (available online at the Texas Parks and Wildlife website www.tpwd.state.tx.us).


I have read and understand the hunting rules and agree to abide by and follow such rules. I understand and accept that violation of any of these rules may result in expulsion from the hunting site and termination of my Hunting Lease without reimbursement for any lease rental paid (including any prepaid amounts).
